Terms of Service

These terms cover use of the WhichTool website, free intake form, and paid assessment services operated by Ben Sneesby (“WhichTool”, “we”, “us”). By using the site or submitting an intake, you agree to these terms.

What WhichTool is

WhichTool helps small businesses identify time leaks and receive practical recommendations for tools, automations, and simple systems. We provide advisory recommendations. We are not your software vendor, accountant, lawyer, or IT managed-service provider unless a separate written agreement says otherwise.

Free intake

The online intake form is free to complete and submit. Submitting the form does not create a paid engagement and does not guarantee that we will offer or accept a paid assessment. We may decline work that is a poor fit.

Paid assessment

The WhichTool Assessment is a one-off service. Current public pricing is AUD 999 including GST for Australian customers, or USD 999 for US customers, unless we agree a different written amount. The assessment typically includes review of your intake, an on-site or agreed walkthrough of the business, a practical time-leak diagnosis, and a prioritised recommendation plan.

Payment terms are confirmed before the paid assessment begins. Unless stated otherwise, payment is due according to the invoice or payment link we send.

5-hour promise

Our public 5-hour promise means: if we cannot show you a practical path to save at least 5 hours per week using suitable tools, automations, or simple systems, we will refund the $999 assessment fee. The promise applies to the assessment recommendation path we present, not to results if recommendations are not implemented, partially implemented, or blocked by factors outside the assessment scope. Refund requests should be emailed to ben@whichtool.ai promptly after the assessment deliverable.

No guaranteed business outcomes

Recommendations are based on information you provide and what we can reasonably observe. Results depend on implementation, team adoption, existing systems, data quality, and your business context. We do not guarantee revenue increases, ranking changes, or specific software performance.

Your responsibilities

  • Provide accurate information in the intake and during the walkthrough
  • Ensure you have authority to share business information with us
  • Review recommendations before purchasing or deploying tools
  • Check current third-party pricing, security, and contract terms yourself before subscribing

Independence

Recommendations are intended to be independent and based on fit. We are not paid by default by the tools we mention. If a commercial relationship with a tool provider exists in future, we will disclose it clearly.

Website content

Guides and website content are general information, not personalised advice. Tool names and price ranges are examples and can change. Always verify details with the provider.

Intellectual property

Website content, branding, and assessment materials we create remain our intellectual property. You may use your assessment deliverable inside your business. You may not resell our materials as a product or public template without written permission.

Acceptable use

Do not misuse the site, attempt unauthorized access, submit unlawful content, or use the intake form for spam or abuse. We may suspend access where needed to protect the service.

Limitation of liability

To the maximum extent permitted by law, WhichTool is not liable for indirect, incidental, special, or consequential loss, or for loss of profits, data, or business opportunity arising from use of the website or reliance on recommendations. Where liability cannot be excluded, it is limited to resupply of the service or a refund of the amount you paid for the specific service giving rise to the claim.

Nothing in these terms excludes rights that cannot be excluded under applicable consumer law.

Governing law

These terms are governed by the laws of New South Wales, Australia, unless mandatory local law requires otherwise for a consumer.
